Terms of Service

These Terms of Service ("Terms") govern your access to and use of GrowthX Go, an AI-powered go-to-market coaching platform operated by GrowthX, Inc., a Delaware corporation ("GrowthX," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility and Account

You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or the entity you represent. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

2. Description of Service

GrowthX Go provides AI-powered coaching, deliverable generation, and strategic guidance for B2B startup founders building their go-to-market strategy. The Service is intended to supplement professional judgment, not replace it.

3. Acceptable Use

You agree to use the Service only for its intended purpose and not to:

• Reverse-engineer, decompile, or attempt to extract the source code or underlying models
• Use the Service to develop competing AI coaching products
• Upload content that is unlawful, harmful, threatening, abusive, or violates third-party rights
• Attempt to bypass rate limits, access controls, or security measures
• Share your account credentials with unauthorized parties
• Use automated scripts or bots to interact with the Service without permission

4. AI-Generated Content

The Service uses artificial intelligence to generate coaching recommendations, deliverables, and strategic guidance. AI-generated content may not always be accurate, complete, or current. You acknowledge that:

• AI outputs are suggestions, not professional advice, and should be validated with your GrowthX coach
• You are solely responsible for decisions made based on AI-generated content
• We do not guarantee the accuracy, reliability, or suitability of AI outputs for any specific purpose
• AI-generated content should not be relied upon as legal, financial, or other professional advice

5. Your Content and Data

You retain ownership of the content you submit to the Service ("Your Content"), including business information, conversation inputs, and deliverable data. By using the Service, you grant us a limited license to process Your Content solely to provide and improve the Service. We will not sell Your Content to third parties.

6. Intellectual Property

The Service, including its design, features, GrowthX methodology content, and underlying technology, is owned by GrowthX and protected by applicable intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you except the limited right to use the Service as described here.

7. Subscription, Billing, and Cancellation

Access to GrowthX Go may be provided free during a GrowthX program or trial, or through a paid subscription. The following terms apply to paid subscriptions:

• Recurring billing and automatic renewal. Subscriptions are billed in advance on a recurring basis (for example, monthly or annually, as presented at checkout) and automatically renew at the end of each billing period at the then-current price. By subscribing, you authorize us and our payment processor to charge your payment method for each renewal until you cancel.
• Cancel anytime. You may cancel at any time from your account settings, the billing portal, or by contacting us. Cancellation stops future renewals; your access continues through the end of the period you have already paid for.
• No refunds. Except where required by law, fees already paid are non-refundable, and we do not provide refunds or credits for partial periods, unused time, or features you did not use.
• Price changes. We may change subscription prices with at least 30 days' advance notice (by email or in the Service). Changes apply to your next renewal; if you do not agree, you may cancel before the change takes effect.
• Payment processing. Payments are processed by Stripe. We do not store your full card number. Your use of payment features is also subject to Stripe's terms, and you are responsible for keeping your payment method valid.
• Failed payments. If a charge fails, we may retry it and may suspend or downgrade your access until payment succeeds. Your data is retained during this period so you can resume once billing is resolved.
• Taxes. Stated prices exclude taxes; you are responsible for any applicable sales, use, or similar taxes.

Canceling, or letting a subscription lapse, deactivates your access but does not by itself delete your account or content - we retain your data so you can pick up where you left off if you return (see our Privacy Policy, and Section 11 for deletion).

8. Service Availability and Modifications

We strive to maintain reliable access to the Service but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue features at any time. We will provide reasonable notice for material changes when possible.

9. Limitation of Liability

To the maximum extent permitted by law, GrowthX and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost profits, data loss, or business interruption. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Termination

Either party may terminate these Terms at any time. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, you may request export of Your Content for a reasonable period, after which we may delete it.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.
